The world is in a financial down spiral at the moment and finances are tight for everyone. The law is too complicated for anyone to face a bankruptcy court without adequate legal representation. The lawyer will compile a list of all outstanding debts, with proof. This indebtedness list will be handed to the bankruptcy court with a list of the petitioner’s monthly expenditure. The good that comes from petitioning the bankruptcy court is that the debtor will from thereon be protected by the law. Over-zealous creditors will no longer be able to harass the debtor and must wait for judgment. Declaring bankruptcy is not an easy step for anyone to take. Yes, it is being given a second chance to start over, but it has far reaching implications that will impact the insolvent person for the rest of his life. A bankruptcy court record is public domain. Years after declaration of bankruptcy people can check up to see if that person has a bankruptcy records. This can ping uncomfortable penalizations. People who have gone through the bankruptcy court most often have self image problems. For most people being declared insolvent is a burden they carry for the rest of their lives.
